default on commercial lease in GA?
My husband and I leased a commercial place in GA as a restaurant 5 years ago. As the bad economy goes, we were not able to keep up with all the rent, we only pay 2500 instead of 6500 in the past 6 month. Now the landlord is demanding the money throught his attorney for the balance we owed about 35000. Since the restaurant is not doing so well, I really can not afford to pay such a large sum nor the future 6500 medications without a prescription in monthly basis. I am wondering can landlord put a lien on my property even I have little equity in my house? The restaurant lease is signed by both me and my husband, so is the house. Also, recently my husband has filed chapter 7 and get discharged. . What should I do at this moments..the attorney is demanding the entire payment within 10 days which I do not have. The lease is for 10 years ending in 2014.

Only my husband filed for chapter 7, I did not. and both of our names are on the lease.

If you will succeed in the Chapter 7, the problem will go away. Let your bk attorney intervene with the landlord’s attorney. They can’t touch your house.
