I don’t know if it makes a difference to the situation, but we filed jointly in ‘08 and our refund & stimulus check were both applied to his debt.

I doubt it, if one party incurred the debt on their own then usually they are solely responsible for it
especially if the debt was inurred before marriage
You can get a form from the IRS and claim yourself as an innocent spouse and get relief from his debt.
No. If he had the debt before you then don’t worry your safe. If it happened while yaw were married then your in a boat.

If you decide to claim a share of his assets, you will be forced to split the liabilities too. If you just walk away uncontested, you will not be required to split
